Kalium L.L.C. doing business as Lens And Linen ("Lens And Linen," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website www.lensandlinen.com (the "Site") and use our services (the "Services").

1. The Roles of the Parties

For the purpose of this policy, it is important to understand two key roles:

  • Data Controller (The Photographer): You, our customer (the professional photographer), are the "Data Controller." You determine the purposes and means of processing personal data. You have a direct relationship with your clients and are responsible for obtaining their legal consent to use their photos.
  • Data Processor (Lens And Linen): We are the "Data Processor." We process personal data (the "Client Photos") on your behalf and at your direction to fulfill your orders.

This policy covers two types of information:

  1. Photographer Information: Information we collect about you, the photographer.
  2. Client Photos & Data: The photographs and any associated client data you upload for us to create products.

2. Information We Collect

A. Photographer Information (Information You Provide to Us)

We collect personally identifiable information about you (the photographer) when you:

  • Create an account on our Site.
  • Place an order for our Services.
  • Contact us through email, contact forms, or customer support.

This information includes:

  • Your Full Name
  • Your Business Name
  • Email Address
  • Phone Number
  • Billing Address
  • Shipping Address
  • Payment information (processed by our secure third-party payment processor)

B. Data Received from Meta (Facebook/Instagram)

When you submit one of our lead forms (instant forms) shown in advertisements on Facebook or Instagram, Meta Platforms, Inc. transmits your submitted information — including your full name and email address — to our systems via the Meta Lead Ads API. We use this data to send you the information you requested (such as product details or download links) and, with your consent, to subscribe you to our marketing communications. You may unsubscribe at any time by clicking the unsubscribe link in any email we send, or by contacting us at info@lensandlinen.com.

C. Cookies and Tracking

We use Matomo (a privacy-focused website analytics platform) to measure site usage, and Meta Pixel to measure advertising effectiveness on Facebook and Instagram campaigns. Both services use cookies and similar technologies to track interactions. You can control cookie preferences through your browser settings or by using Do Not Track signals, which our site respects where technically feasible.

D. Client Photos & Data (Information We Process for You)

When you use our Services, you will upload digital files ("Client Photos") to be used in our products (photo books, notepads, USBs, etc.). These Client Photos are the personal data of your clients. We do not collect this data ourselves; we process it solely based on your instruction (i.e., your order).

3. How We Use Your Information

A. Use of Photographer Information

We use the information we collect about you (the photographer) to:

  • Create and manage your account.
  • Fulfill and manage your orders.
  • Process payments and refunds.
  • Communicate with you about your orders, account, or our Services.
  • Email you with updates, newsletters, or promotional offers (you may opt out at any time).
  • Improve our Site and Services.

B. Use of Client Photos & Data

Our use of Client Photos is strictly limited. We use Client Photos only to:

  • Manufacture the specific products you have ordered.
  • Perform quality control checks on those products.
  • Fulfill the shipment of the final products to you or your designated recipient.

We will never use the Client Photos for any other purpose, such as marketing, advertising, or selling them, without your explicit, separate consent.

4. How We Share Information

We do not sell, rent, or trade your information. We may share information in the following limited circumstances:

  • Service Providers: With third-party vendors who perform services for us, such as payment processing, printing labs, product manufacturing, and shipping carriers. These vendors are contractually bound to protect your data and are only permitted to use it to fulfill the service we have requested.
  • Email and CRM Services: We use FluentCRM (self-hosted on our own servers) to manage customer relationships, lead contacts, and email subscriptions. We use Amazon Simple Email Service (SES) as the delivery infrastructure for our transactional and marketing emails. We use Matomo for website analytics and Meta Pixel for advertising measurement and attribution. These services process only the minimum data necessary to deliver the functionality described in this policy.
  • Legal Requirements: If required by law, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.

5. Data Storage & Deletion

A. Photographer Information

We will retain your account information as long as your account is active or as needed to provide you Services, comply with our legal obligations, and resolve disputes.

B. Marketing Contact Retention

If you provided your contact information through a lead form, signup form, or marketing subscription without creating an account, we retain your information for as long as you remain subscribed to our communications. You may unsubscribe at any time. Inactive contacts (no email engagement for 24 months) are automatically removed from our systems.

C. Client Photos & Data

We understand that Client Photos are sensitive. Our policy is to minimize the time we store this data.

We will automatically and permanently delete all Client Photos associated with your order 90 days after your order has been successfully fulfilled and shipped.

6. Data Security

We use administrative, technical, and physical security measures to help protect your personal information and the Client Photos you upload. This includes SSL technology, data encryption, and secure-access controls for our servers.

Client Photos and order data are stored on secure servers operated by reputable cloud providers (such as Amazon Web Services or Backblaze B2) using encryption in transit and at rest. Access to these files is restricted to authorized personnel only for production and support purposes.

While we have taken reasonable steps to secure the data you provide to us, please be aware that no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.

7. Your Data Protection Rights

You have rights regarding your personal data. As our customer (the photographer), you can:

  • Access, correct, or update your account information at any time.
  • Request the deletion of your account.
  • Opt out of our marketing communications.

As the "Data Processor," we will assist you, the "Data Controller," in fulfilling any data rights requests (e.g., access or deletion) you may receive from your clients regarding the photos we are processing for you.

8. Data Deletion Request

You have the right to request deletion of all personal information we hold about you. To submit a deletion request, email info@lensandlinen.com with the subject line "Data Deletion Request" and include the email address associated with your data. We will delete your information within 30 days and send written confirmation to the email address you provided. You may also remove yourself from our marketing communications at any time by clicking the unsubscribe link in any email.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date.
